This week, the U.S. Department of Education published new Frequently Asked Questions (FAQs), Disposition of Equipment and Supplies, Emergency Assistance to Non-Public Schools (EANS) Program (EANS Disposition FAQs). These new FAQs provide clarification on the requirements regarding the continued use and disposal of equipment and supplies at the end of the EANS performance period. This document is an addendum to the previously published, Frequently Asked Questions – Emergency Assistance to Non-Public Schools (EANS) Program – as authorized by the Coronavirus Response and Relief Supplemental Appropriations Act, 2021 (CRRSA Act) and the American Rescue Plan Act of 2021 (ARP Act), September 17, 2021.
The new EANS Disposition FAQs provide guidance on:
- The length of time equipment and supplies purchased with EANS funds may be used in a non-public school;
- The process for determining if a non-public school may continue to use supplies and equipment beyond the period of performance;
- Administrative requirements; and,
- The process for disposing of equipment and supplies.
